Please read them carefully before using BeamMe.</p>\n\n<h2>2. Eligibility</h2>\n<p>You must be at least <strong>17 years of age</strong> to use BeamMe. By creating an account, you represent and warrant that you are at least 17 years old and have the legal capacity to enter into these Terms. If you are under 17, you may not use the Service.</p>\n\n<h2>3. Description of Service</h2>\n<p>BeamMe is an AI-powered image generation application that allows users to create images of themselves in various settings and styles using artificial intelligence technology. The Service uses your uploaded photos as reference to generate new images based on your text descriptions (\"prompts\").</p>\n\n<h2>4. AI-Generated Content Disclaimer</h2>\n<p><strong>All images produced by BeamMe are generated by artificial intelligence and are not real photographs.</strong> By using this Service, you acknowledge and agree that:</p>\n<ul>\n<li>Generated images are <strong>AI-created compositions</strong> — they do not depict real events or situations</li>\n<li>AI-generated images may contain <strong>inaccuracies, artifacts, or imperfections</strong></li>\n<li>The AI may not perfectly reproduce your likeness, features, or requested scene</li>\n<li>Results may vary and are <strong>not guaranteed</strong> to match your expectations</li>\n<li>Generated images should <strong>not be presented as authentic photographs</strong> without clear disclosure that they are AI-generated</li>\n<li>You are solely responsible for how you use, share, and distribute generated images</li>\n</ul>\n\n<h2>5. User Accounts</h2>\n<p>You must create an account to use BeamMe. You are responsible for:</p>\n<ul>\n<li>Providing accurate and complete account information</li>\n<li>Maintaining the confidentiality and security of your password</li>\n<li>All activities that occur under your account</li>\n<li>Notifying us immediately of any unauthorized access or use of your account</li>\n</ul>\n<p>You may not create multiple accounts, share your account credentials, or transfer your account to another person.</p>\n\n<h2>6. Acceptable Use Policy</h2>\n<p>You agree <strong>not</strong> to use BeamMe to:</p>\n<ul>\n<li><strong>Create non-consensual intimate imagery</strong> (NCII) of any person</li>\n<li><strong>Generate images of minors</strong> in inappropriate, suggestive, sexual, or harmful contexts</li>\n<li><strong>Create deepfakes</strong> intended to deceive, defraud, defame, or harm others</li>\n<li><strong>Harass, bully, threaten, or intimidate</strong> any person using generated images</li>\n<li><strong>Impersonate others</strong> for fraudulent, deceptive, or malicious purposes</li>\n<li><strong>Generate content that promotes</strong> violence, terrorism, self-harm, hate speech, discrimination, or illegal activities</li>\n<li><strong>Create sexually explicit content</strong> or pornographic material</li>\n<li><strong>Violate intellectual property rights</strong> of third parties</li>\n<li><strong>Upload photos of others</strong> without their explicit, informed consent</li>\n<li><strong>Attempt to circumvent</strong> content moderation or safety filters</li>\n<li>Use the Service for any purpose that violates applicable laws or regulations</li>\n</ul>\n<p><strong>Violation of this policy may result in immediate account suspension or termination without refund.</strong> We may also report illegal activity to law enforcement authorities.</p>\n\n<h2>7. Photo Upload &amp; Consent</h2>\n<p>By uploading photos to BeamMe, you represent and warrant that:</p>\n<ul>\n<li>You are the person depicted in the photos, or you have obtained explicit written consent from the person depicted</li>\n<li>You have the legal right to upload and use these photos</li>\n<li>You consent to your photos being processed by third-party AI services (including OpenAI, Google Gemini, and FAL AI) for the sole purpose of generating AI images</li>\n<li>You understand that your photos are transmitted securely to these services and are used only to fulfill your image generation requests — they are not used for AI model training</li>\n</ul>\n\n<h2>8. Intellectual Property &amp; Content Ownership</h2>\n<ul>\n<li><strong>Your photos:</strong> You retain all rights to the original photos you upload</li>\n<li><strong>Generated images:</strong> Subject to these Terms, you are granted a personal, non-exclusive, non-transferable license to use AI-generated images</li>\n<li><strong>Personal use:</strong> All users may use generated images for personal, non-commercial purposes</li>\n<li><strong>Commercial use:</strong> Generated images may be used commercially only with an active paid subscription plan, subject to applicable laws regarding AI-generated content in your jurisdiction</li>\n<li><strong>BeamMe branding:</strong> The BeamMe name, logo, and app design are our intellectual property and may not be used without written permission</li>\n<li><strong>No ownership claim:</strong> We do not claim ownership of your uploaded photos or generated images</li>\n</ul>\n\n<h2>9. Subscriptions &amp; Payments</h2>\n\n<h3>9.1 Subscription Plans</h3>\n<p>BeamMe offers free and paid subscription plans. Paid plans provide additional credits, features, and capabilities. Plan details and pricing are displayed within the app.</p>\n\n<h3>9.2 Auto-Renewal — Apple App Store (iOS)</h3>\n<ul>\n<li>Payment will be charged to your <strong>Apple ID account</strong> at the confirmation of purchase</li>\n<li>Subscription automatically renews unless it is canceled <strong>at least 24 hours before the end of the current period</strong></li>\n<li>Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate</li>\n<li>You can manage and cancel your subscriptions by going to your <strong>Account Settings on the App Store</strong> after purchase</li>\n<li>Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription</li>\n</ul>\n\n<h3>9.3 Auto-Renewal — Google Play / Stripe (Android)</h3>\n<ul>\n<li>Subscriptions are billed at the start of each billing period through <strong>Stripe</strong> or <strong>Google Play</strong></li>\n<li>Subscriptions automatically renew unless canceled before the renewal date</li>\n<li>You can manage and cancel subscriptions through the app settings or your payment provider</li>\n<li>Cancellation takes effect at the end of the current billing period — you retain access until then</li>\n</ul>\n\n<h3>9.4 Credits</h3>\n<p>Credits are the virtual currency used to generate images within BeamMe.</p>\n<ul>\n<li>Credits are <strong>non-transferable</strong> between accounts</li>\n<li>Credits are <strong>non-refundable</strong> except where required by applicable law</li>\n<li>Unused credits from subscription plans <strong>do not roll over</strong> to the next billing period</li>\n<li>Purchased credit packages <strong>do not expire</strong> as long as your account remains active</li>\n<li>Credits have no monetary value and cannot be exchanged for cash</li>\n</ul>\n\n<h3>9.5 Refunds</h3>\n<ul>\n<li><strong>Failed generations:</strong> If an image generation fails due to a technical error on our end, credits are automatically refunded to your account</li>\n<li><strong>Subscription refunds (iOS):</strong> Refund requests must be submitted through Apple. Content Moderation &amp; Safety</h2>\n<p>BeamMe employs automated and manual content moderation systems to prevent the generation of harmful, illegal, or inappropriate content. We may:</p>\n<ul>\n<li>Block or filter prompts that violate our Acceptable Use Policy</li>\n<li>Refuse to generate images that our AI safety systems flag as inappropriate</li>\n<li>Review and remove generated content that violates these Terms</li>\n<li>Suspend or terminate accounts that repeatedly violate our policies</li>\n<li>Report illegal content or activity to appropriate law enforcement authorities</li>\n</ul>\n<p>Content moderation decisions are made at our sole discretion. We are not obligated to provide specific reasons for content refusal.</p>\n\n<h2>11. Disclaimer of Warranties</h2>\n<p>To the maximum extent permitted by applicable law:</p>\n<ul>\n<li>BeamMe is provided <strong>\"AS IS\"</strong> and <strong>\"AS AVAILABLE\"</strong> without warranties of any kind, whether express, implied, or statutory</li>\n<li>We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement</li>\n<li>We do not warrant that the Service will be uninterrupted, error-free, or secure</li>\n<li>We do not warrant the accuracy, quality, or reliability of any AI-generated content</li>\n</ul>\n\n<h2>12. Limitation of Liability</h2>\n<p>To the maximum extent permitted by applicable law:</p>\n<ul>\n<li>We are <strong>not liable</strong> for any indirect, incidental, special, consequential, or punitive damages</li>\n<li>We are <strong>not responsible</strong> for how users share, distribute, or use generated images</li>\n<li>Our total aggregate liability shall not exceed the amount you paid for the Service in the <strong>12 months preceding the claim</strong></li>\n<li>This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise)</li>\n</ul>\n<p>Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. Indemnification</h2>\n<p>You agree to indemnify, defend, and hold harmless EAGENCY WEB DESIGN SRL, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:</p>\n<ul>\n<li>Your use of the Service</li>\n<li>Your violation of these Terms</li>\n<li>Your violation of any rights of a third party</li>\n<li>Content you generate, share, or distribute using BeamMe</li>\n</ul>\n\n<h2>14. Account Termination</h2>\n<ul>\n<li><strong>By you:</strong> You may delete your account at any time through the app settings. Upon deletion, all your data will be permanently removed in accordance with our Privacy Policy</li>\n<li><strong>By us:</strong> We may suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct that we determine is harmful to other users, us, or third parties</li>\n<li><strong>Effect of termination:</strong> Upon termination, your right to use the Service ceases immediately. Any unused credits or remaining subscription time may be forfeited</li>\n</ul>\n\n<h2>15. Changes to Terms</h2>\n<p>We reserve the right to modify these Terms at any time. When we make material changes, we will:</p>\n<ul>\n<li>Post the updated Terms within the app and on our website</li>\n<li>Update the \"Last Updated\" date</li>\n<li>Notify you via email or in-app notification for significant changes</li>\n</ul>\n<p>Your continued use of BeamMe after changes constitutes acceptance of the updated Terms. If you disagree with any changes, you should stop using the Service and delete your account.</p>\n\n<h2>16. Governing Law &amp; Dispute Resolution</h2>\n<p>These Terms shall be governed by and construed in accordance with the laws of <strong>Romania</strong> and the <strong>European Union</strong>, without regard to conflict of law principles.</p>\n<p>Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the competent courts of Târgoviște, Dâmbovița, Romania.</p>\n<p>If you are a consumer in the EU, you may also use the <a href=\"https://ec.europa.eu/consumers/odr\">EU Online Dispute Resolution platform</a>.</p>\n\n<h2>17. Severability</h2>\n<p>If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.</p>\n\n<h2>18. Entire Agreement</h2>\n<p>These Terms, together with our <a href=\"https://beamme.net/api/v1/legal/privacy-policy\">Privacy Policy</a>, constitute the entire agreement between you and EAGENCY WEB DESIGN SRL regarding your use of BeamMe, superseding any prior agreements.</p>\n\n<h2>19.
